Personal Injury Attorney in Fayetteville

Work Directly with an Attorney with 40+ Years of Experience

I represent people and families in Fayetteville, Georgia who have been harmed in accidents, workplace incidents, and other preventable events. At Law Offices of K. Douglas Cook, I draw on more than 40 years of legal experience to handle personal injury and fatal injury claims throughout Georgia.

A 25% Contingency Fee for Out-of-Court Settlements

I charge a 25% contingency fee when a case is resolved through an out-of-court settlement. The fee is paid from the recovery rather than charged upfront. If there’s no recovery, you pay nothing.

The consultation is also free. I can explain the fee agreement and answer questions about case expenses before you decide whether to move forward.

Personal Injury Cases I Handle for Fayetteville Residents

I have handled more than 4,000 cases over the course of my career, including claims involving traffic collisions, unsafe property conditions, professional negligence, workplace incidents, and serious injuries.

The personal injury matters I handle include:

  • Car accidents: Distracted driving, drunk driving, hit-and-run, head-on, rear-end, and rideshare accidents
  • Bicycle accidents
  • Pedestrian accidents
  • Motorcycle accidents
  • Truck accidents
  • Bus accidents
  • Catastrophic injuries: Burns, paralysis, and brain injury
  • Medical malpractice
  • Nursing home abuse
  • Dog bites
  • Premises liability: Slip and fall and negligent security claims
  • Work accidents
  • Workers’ compensation
  • Wrongful death

When negligent or wrongful conduct causes a death, the resulting claim involves different damages and legal rights from a claim brought by an injured person. I help families determine which claim applies and guide them through the legal process.

What to Expect After You Contact Me

The process begins with a free consultation focused on how the incident occurred, the injuries involved, the available evidence, and your immediate questions. I then provide personalized attention and strategic guidance based on the circumstances.

Representation may involve reviewing evidence, communicating with insurers, negotiating a settlement, and pursuing litigation when necessary. I remain your main point of contact throughout the case, including when important developments or decisions arise.

Damages & Fault Under Georgia Personal Injury Law

Depending on the evidence and type of claim, damages may address both financial losses and non-economic harm. Financial losses can include medical costs and lost income, while non-economic damages can account for pain and suffering.

Georgia follows modified comparative fault, which considers whether more than one party contributed to an incident. Compensation is reduced by the claimant’s percentage of fault. Someone found 50% or more at fault can’t recover damages under this rule.

Georgia Filing Deadlines for Injury Claims

A statute of limitations sets the deadline for filing a lawsuit. Under O.C.G.A. § 9-3-33, most Georgia personal injury actions generally must be brought within two years after the right of action accrues. Wrongful death claims generally have a two-year deadline from the date of death, although the specific facts can affect the applicable period.

A loss-of-consortium claim, which concerns the loss of a spouse’s companionship and related marital benefits, generally has a four-year deadline under O.C.G.A. § 9-3-33. Different timing rules may apply when a government body is involved. Claims against a municipality generally require notice within six months, while claims against the State of Georgia generally require ante litem notice within 12 months.

Ante litem notice is a formal notice required before certain claims against a government entity can proceed. These notice periods may expire before the ordinary two-year filing deadline, so identifying the responsible parties early is important.

Fayette County Courts & Civil Injury Lawsuits

The Fayette County Justice Center in Fayetteville houses Superior, State, Magistrate, Probate, and Juvenile Court functions. Fayette County Superior Court is part of the Griffin Judicial Circuit and is a court of general jurisdiction that hears major civil actions.

An injury occurring in Fayetteville or Fayette County, Georgia doesn’t by itself determine where a lawsuit must be filed. The proper court and filing requirements depend on the parties, the nature of the claim, the amount in dispute, and jurisdictional rules. I evaluate these considerations when handling a personal injury case.

    "Great Job - Highly Recommend"
My car was back ended and I had whiplash. The whole insurance thing was totally confusing. My doctor recommended the Law Offices of Douglas Cook and I couldn't be more happy. I was hoping to just get most of my medical bills paid but I got those bills paid and received a settlement. I worked with Steven and the whole process was relaxed and straightforward. I also learned about bodily injury claims and medpay which was already on my policy. So, this worked out very nicely and I recommend these guys. Doug is very easy to talk to and very informative. I will use them again if I need help.

"Attorney Cook is #1 in my book and if you're searching for an attorney"
One Saturday afternoon I went shopping at Wal-Mart and as I walk across the parking lot to my car I'm struck by a car. Long story short, I was going to try and represent myself but later decided against it. I did a thorough online research and found the wonderfully awesome K. Douglas Cook. He took over my case and the rest is history. He settled my case for far more than I imagined. Attorney Cook is #1 in my book and if you're searching for an attorney he should be #1 in yours too. K.
